How do I protect my slogan?
We must take into account three types of means, which can provide us with a cumulative defense:
- Registered Trademark
- Copyright
- Unfair competition
- To get it registered as a trademark®️. Our first objective should be to get it without accompanying our main brand, so as not to distort it in the sense that it can be interpreted as something secondary; But for this our slogan should not:
- be of a generic nature
- describe the products or services we want to cover
- have a laudatory character
- Copyright©️. If we can prove the moment of creation, we already have something else to fall back on.
- Unfair competition. It seems logical to think that, if a competitor imitates a slogan like ours, it is trying to take advantage of the advertising investment we have made, and that it may confuse the consumer public about the origin of the product.
